HOW ARE PBMs POSSIBLE?
PBMs emerged to act as a middleman to manage prescription drug benefits for health insurance plans. However, their lack of transparency and pricing practices has had a negative impact on pharmacies and patients.
SB 843 BILL:
This bill prohibits pharmacy benefit managers from overcharging health plans for prescription drugs.
HB 1627 BILL:
Holds PBMs to transparency standards that prioritize the welfare of patients and payers over their own financial interests.
WHAT TAKING ACTION LOOKS LIKE:
REGULATORY REFORMS
Reviewing and updating existing regulations to address potential loopholes and ensure that PBMs operate in a way that benefits pharmacies, patients and healthcare.
COMPETITION PROMOTION
Encouraging competition among PBMs to ensure fair negotiations with pharmacies and medication manufacturers.
TRANSPARENCY LEGISLATION
Implementing regulations that enhance transparency about PBM practices, including pricing arrangements and rebates.
COLLABORATION
Healthcare providers can play a role by negotiating fair terms with PBMs ensuring that patient care is not compromised due to financial considerations.
